Abstract:

In this paper it is discussed, how the EU health care policy might influence national health care systems and their reform agendas. Important EU competences can be seen especially in the areas of patient mobility and the pharmaceutical market. Especially the 'transformation' of the fundamental freedoms and he competition law to use them for justifying an EU–health care policy is an important strategy to build up competences in this policy field. The CoJ and the Commission are driven by different motivations and play distinguishable roles in this process.
